Hyderabad: On Tuesday, the Telangana Assembly Secretary issued notices to 10 Bharat Rashtra Samithi (BRS) MLAs who defected to the ruling Congress party last year. The notices were sent in response to petitions filed by BRS, seeking the disqualification of these defected MLAs. The MLAs have requested time to respond to the notices issued by the Assembly Secretary.

This development follows a recent directive from the Supreme Court, which asked the Telangana Assembly to define a "reasonable period" for making a decision on disqualification petitions. The Court's bench, comprising Justices B.R. Gavai and Vinod Chandran, instructed Senior Advocate Mukul Rohatgi (representing the Telangana Legislative Assembly Secretary) to consult the Speaker and present views on an appropriate timeframe for the decision.

The Supreme Court has adjourned the hearing of a petition filed by BRS MLA P. Kaushik Reddy, seeking the disqualification of three defected MLAs—Venkata Rao Tellam, Kadiyam Srihari, and Danam Nagender—until February 10. Additionally, BRS working president K.T. Rama Rao has filed a petition in the Supreme Court, questioning the delay by the Assembly Speaker in deciding on the disqualification of seven other defected MLAs. The Supreme Court has consolidated both petitions and scheduled a hearing for February 10.

The BRS camp is optimistic following the Supreme Court's recent observations. On Monday, K.T. Rama Rao urged party workers to be ready for by-elections, stating, “It is impossible for the Congress party to shield the defectors anymore as the Constitution and Supreme Court precedents are explicitly clear.”

A division bench of the Telangana High Court, on November 22, 2024, had directed the Speaker to decide on the disqualification within a "reasonable time." This order overturned a previous ruling by a single judge, which had directed the Speaker’s office to announce a schedule for disqualification hearings within four weeks.

The High Court's ruling emphasized that the Speaker should make decisions based on the Anti-Defection Act, keeping in mind the five-year term of the Assembly. In September, the High Court had ordered the Speaker’s office to announce a schedule for the disqualification hearings, and the Legislative Secretary had challenged this order in an appeal.

The defection of 10 BRS MLAs to Congress over the past year includes prominent figures like former Deputy Chief Minister Kadiyam Srihari and former Assembly Speaker P. Srinivasa Reddy.
